Membership term:

The minimum term for all sugaring, waxing and laser memberships is three (3) consecutive months starting from your membership start date (“minimum term”). Each month following the membership start date constitutes an “agreement month.” Unless terminated in accordance with this agreement, memberships will automatically renew month to month after the minimum term. To prevent renewal, written notice must be provided prior to the next agreement month billing date.

Termination:

This membership agreement may be terminated only under the following conditions:

- Voluntary termination: You may terminate your membership by providing written notice at least thirty (30) days before your next billing date. If termination occurs within the minimum term and monthly fees remain unpaid, WaxKitty reserves the right to charge your credit card immediately for any remaining fees due within that minimum term.
- Relocation or medical disability: You may terminate your membership immediately, without penalty, if you relocate more than 40 kilometers from the nearest WaxKitty location or if a certified medical condition or disability prevents you from utilizing services. Valid supporting documentation must accompany your termination notice. You remain responsible for the current agreement month’s fee, but no further charges will apply.
- Price increase: In the event WaxKitty increases membership pricing, you will be notified via email. You have thirty (30) days from receipt of such notice to terminate your membership. Failure to respond within this timeframe constitutes acceptance of the new rates. Upon valid termination, you remain responsible for the current agreement month’s fee, with no further charges applicable.
- Termination by WaxKitty: WaxKitty reserves the right to terminate your membership at any time with written notice. You remain responsible for the current agreement month’s fee, but no further charges will apply.
- Effect of termination: Upon termination or cancellation, all unused service credits, loyalty points, or any other membership-related benefits immediately expire and cannot be redeemed.

Membership freeze and changes:

You may freeze your sugaring or waxing membership once every four (4) agreement months for a period of one agreement month by providing written notice prior to the billing date of the month you wish to freeze. During this freeze period, new service credits will not be issued; however, existing credits will roll over for use in the subsequent agreement month. Membership upgrades or downgrades can be requested in person or in writing at any time, subject to WaxKitty’s approval.

‍Membership services and discounts:

- SugarPass membership: one (1) complimentary Brazilian sugaring (for women) per agreement month.
- WaxPass membership: one (1) complimentary Brazilian waxing (for women) per agreement month.
- KittyMe, SugarPass and WaxPass memberships: 20% discount on all sugaring and waxing services, excluding add-ons.
- LaserPass membership: Members receive 40% off all laser hair removal services. Payments are charged every five (5) weeks, and every fourth (4th) payment can be waived. All payments made for the LaserPass membership are credited to your account, do not expire, and upon cancellation or expiration of the membership, accumulated credits will be transferred to a prepaid card redeemable at regular pricing for any WaxKitty service.
- Mini LaserPass: Members receive 40% off specific laser hair removal services as detailed in the mini LaserPass membership terms.

Services must be utilized within the agreement month issued and are non-transferable and non-refundable.

‍Payment terms:

You authorize WaxKitty to charge your provided credit card monthly, commencing on or about the first day of each agreement month. All membership fees listed exclude Harmonized Sales Tax (HST), which will be added at the applicable rate. If pre-authorized payments fail for three consecutive months, WaxKitty reserves the right to terminate your membership immediately without notice.

‍Assignment:

Membership rights and obligations under this agreement are personal to you and non-transferable. WaxKitty reserves the right to assign its rights and obligations under this agreement with prior written notice to you.

Disclaimer and release:‍

You acknowledge that WaxKitty’s waxing, sugaring and laser hair removal services involve inherent risks, including but not limited to redness, swelling, burns, irritation, bruising, skin sensitivity, pigmentation changes, infection, scarring, allergic reactions, and temporary or permanent changes in skin texture or colour. You understand that individual reactions vary, and WaxKitty cannot guarantee specific outcomes. By signing this agreement, you accept these risks and release, waive and indemnify WaxKitty, its owners, directors, employees, agents, affiliates, successors and assigns from any and all liabilities, claims, demands, damages or causes of action arising from your participation in these treatments or services. You further agree to promptly inform WaxKitty of any skin conditions, medical history, medications, allergies, disabilities or prior treatments which could affect the safety and suitability of these services for you.

Governing law:‍

This agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from this agreement will be exclusively adjudicated in the courts located in Toronto, Ontario.

Agreement to membership policies:‍

You agree to abide by all current and future WaxKitty membership policies communicated via email, posted on the WaxKitty website, or displayed at WaxKitty locations.

Notices:

WaxKitty™, a division of 2858710 Ontario Inc. (“WaxKitty,” “we,” “us,” or the “company”), requires that all notices relating to this agreement be in writing. Notices must be delivered by mail or email to the contact information provided by the member (“you”) or WaxKitty, as appropriate.
